General Terms and Conditions

1) Scope


1.1 These terms of use apply to the use of the eLearning platform under the domainacademy.mystim.com, operated by Mystim GmbH.

1.2 The platform provides free content and training materials, which are partially accessible without registration and partially only after creating a user account.

1.3 Mystim GmbH reserves the right to change these terms of use. Users will be informed in a timely manner about changes. Continued use of the platform after notification of changes is considered acceptance of the new terms.

1.4 Separate terms and conditions apply for the purchase of goods through other websites of Mystim GmbH.

2) Description of Services


2.1 The platform offers digital learning content, courses, and training materials.

2.2 The provider is entitled to change, expand, or remove content at any time.

2.3 There is no claim to the availability of the platform at all times.

3) Registration and User Account


3.1 Registration is required for certain content.

3.2 The data provided during registration must be complete and accurate.

3.3 The access data for the user account must be treated confidentially. Users are obliged to keep their access data secret and to protect it from unauthorized access.

3.4 Users are responsible for all activities that occur using their access credentials.

3.5 The provider is entitled to suspend or delete user accounts in case of violations of these terms or if there is suspicion of misuse.

3.6 The privacy policy of Mystim GmbH applies to the registration and use of the platform, which you can view in ourprivacy policy.

4) Usage Rights


4.1 All content, brands, logos, and other materials on the platform are protected by copyright. Any use outside the rights granted within the scope of this course is prohibited.
4.2 Users are granted a simple, non-transferable, non-exclusive right to use the content solely for their own training or educational purposes within the scope of this course.
4.3 Without the express written consent of the rights holder, it is prohibited to:

reproduce, distribute, or make content publicly accessible, except for training purposes,
share access credentials, use content commercially, modify it, or otherwise exploit it.


5) Availability


5.1 The provider strives for as uninterrupted a use of the platform as possible.

5.2 Maintenance work, technical disruptions, or external influences may lead to limitations.

6) Liability


6.1 The content is intended solely for general informational purposes.

6.2 The provider does not guarantee the accuracy, completeness, or timeliness of the content.

6.3 The provider is fully liable for intent and gross negligence as well as for violations of life, body, or health.

6.4 For other damages, the provider is only liable to the extent that they are based on intentional or grossly negligent breaches of duty or a guarantee has been assumed.

6.5 The provider is not liable for damages arising from the use or non-use of the content, unless they are based on intent or gross negligence.

7) Misuse of the platform and copyright

7.1 It is prohibited to use the platform for illegal purposes or in a manner that violates applicable law.
7.2 In particular, the following is prohibited:

  • to circumvent or violate access restrictions,
  • automated access using bots, scraping, or similar methods,
  • manipulation of the platform, its content, or functions,
  • the violation of copyrights, trademark rights, or other protective rights through the use of the platform.

8) Termination of use


8.1 Users have the option to delete their account at any time or to request deletion.

8.2 The provider may suspend or delete user accounts in the event of violations of these terms or for legitimate interests.

9) Applicable law


The law of the Federal Republic of Germany applies.

10) Jurisdiction


If the user is a merchant, a legal entity under public law, or a special fund under public law, the exclusive jurisdiction is the location of the provider.

11) Changes to the terms of use


The provider reserves the right to change these terms of use at any time. Users will be informed of changes in a timely manner. Continued use of the platform after the announcement of changes is considered acceptance of the new terms.

12) Severability Clause


Should individual provisions of these terms of use be or become ineffective, the effectiveness of the remaining provisions shall remain unaffected. Instead of the ineffective clause, a provision that comes closest to the economic purpose shall apply.

13) Final Provisions


13.1 The language of the contract is German.

13.2 There is no entitlement to uninterrupted availability of the platform.
